What To Do If A Loved One Is Detained by ICE

1.  Don’t panic. Take a deep breath and read this checklist. 

2. If you have a chance to speak with your detained loved one, remind them of their right to remain silent and their right to ask for an attorney. THIS IS CRITICAL. ICE can and will use everything they say against them. Also, they should not sign any document that they do not understand. 

3. Ask your loved one for their “A” or “Alien” number. This is a 9-digit number that ICE will use to identify their case. It is like a social security number because no one else will have the same number. 

4. Call the immigration court system at 1-800-898-7180 using their A number to see if they have been scheduled for a court date. 

5. Locate your loved one. You may ask them, but sometimes they will be moved. You can log on here https://locator.ice.gov/odls/#/index to find them by their A number and country of birth OR by their name, date of birth, and country of birth. Please note that the information may not be available right away. It takes a few days for ICE to process detainees so do not panic if you cannot find them online. 

6. Contact a reputable and knowledgeable immigration attorney to schedule a consultation. Even though your loved one may be facing deportation, they may have a strong defense against deportation and a lawyer will help you figure it out. 

7. Obtain criminal records. If you know this person has ever been arrested/convicted of a crime, your immigration attorney will need to see those records. If your loved one was arrested in Alameda County, you can go to a criminal court within the county and do a records search using the name and date of birth of your loved one. These records are public and will be released to you, unless the person was a minor when this happened. I recommend getting them certified which costs approximately $25 per document. If you cannot afford to certify, that’s ok, just obtain regular copies. 

8. Collect the following personal records:

a. Birth certificates for your loved one and their family members, especially if he/she/they have children and a spouse born in the U.S.; 

b. Marriage license, and/or divorce decree;

c. Income tax returns for as many years as possible;

d. Pay stubs for the last year;

e. School records of their children; 

f. If your loved one, their children, or spouse have medical issues, obtain medical records;

g. Letters of support from employer, family, and friends stating all positive qualities of your loved one (hard worker, great parent, kind, generous, honest, trustworthy, etc.) 

9. Gather all immigration documents. If there are none, that’s ok. 

10. The criminal, personal, and immigration records may not only help your loved one get released from detention, but it may help build an immigration case. Plus, your immigration lawyer will be very happy with you.

  ¿Qué hacer si un ser querido es detenido por ICE?

1. No entre en pánico. Tome un respiro profundo y lea esta lista de información.

3. Pida a su ser querido su número “A” o número de “Extranjero.” Este es un numero de 9-dijitos que ICE usara para identificar su caso. Este es como un seguro social ya que nadie más tendrá el mismo número.

4. Llame a el sistema de corte de inmigración al 1-800-898-7180 usando el numero A para investigar si su ser querido ha sido otorgado una fecha para su corte. 

5. Localice su ser queridoUsted puede preguntarle, pero algunas veces ellos son trasladados. Usted puede entrar al siguiente enlace https://locator.ice.gov/odls/#/index para encontrarlo usando su número A y país de nacimiento, O por su nombre, fecha y país de nacimiento. Por favor, considere que la información no estará disponible al instante. A ICE le toma algunos días para hacer el procedimiento del detenido, así que no entre en pánico si usted no lo puede encontrar información en línea. 

6. Contacte un abogado de inmigración con buena reputación y conocimiento para programar una consulta. Aunque su ser querido este enfrentando una deportación, puede que el/ella tenga una defensa fuerte ante la deportación y un abogado lo/a ayudara a averiguarlo. 

7. Obtenga su expediente criminal. Si usted sabe que esta persona ha sido arrestada/condenada por un crimen, su abogado de inmigración necesitara ver esos expedientes. Si su ser querido fue arrestado en el condado de Alameda, usted puede ir a la corte criminal del condado y hacer una investigación de su expediente usando el nombre y fecha de nacimiento de su ser querido. Estos expedientes son públicos y le serán otorgados, al menos que esta persona era menor de edad cuando esto paso. Yo les recomiendo que los obtenga certificados lo cual cuesta aproximadamente $25 por documento. Si usted no puede pagar el certificado, esta bien, solo obtenga copias regulares. 

8. Reúna los siguientes documentos personales:

a. Actas de Nacimiento de su ser querido y miembros familiares, especialmente si el/ella/ ellos tienen hijos y esposo/a nacidos en los Estados Unidos;

b.  Licencia de matrimonio, y/o certificado de divorcio.;

c. Impuestos por todos los años posibles;

d. Talones de cheque por el último año;

e. Expediente escolar de sus hijos;

f. Si su ser querido, sus hijos, y/o esposa tienen alguna enfermedad médica, obtenga su expediente médico;

g. Cartas de apoyo de su empleador, familia, y amigos donde ellos testifiquen todas las cualidades positivas de su ser querido (buen trabajador, buen padre, amable, generoso, honesto, confiable, etc.)

9. Reúna todos los documentos de inmigración. Si no tiene, está bien.

10. El expediente criminal, los documentos de inmigración personales no solo ayudaran a sacar a su ser querido de detención, pero ayudaran a construir un caso de inmigración. En adición, su abogado de inmigración estará muy contento con usted.
